By using Ember Client, you agree to our Terms of Service.
Introduction
This document outlines the terms and conditions ("Terms") under which Clyent Softwares Ltd ("Clyent", "we", "us", or "our") provides you ("you" or "your") with access to and use of Ember Client ("the Service"). By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service. Ember Client is NOT AN OFFICIAL MINECRAFT PRODUCT OR SERVICE, and it is NOT APPROVED BY OR ASSOCIATED WITH MOJANG OR MICROSOFT. Please note that Ember Client is a third-party modification for Minecraft created by Clyent Softwares Ltd. It is essential to understand that any issues, disputes, or concerns regarding Ember Client should be directed to Clyent Softwares Ltd, not Mojang or Microsoft.
License
Subject to your compliance with these Terms, Clyent grants you a limited, non-exclusive, non-transferable, revocable license to use Ember Client solely for your personal use. You may not use Ember Client for any other purpose without our prior written consent. You agree not to: - Reverse engineer, decompile, disassemble, attempt to derive the source code of, or decrypt Ember Client - Modify, adapt, translate, or create derivative works based on Ember Client - Remove, alter, or obscure any proprietary notices, labels, or marks on Ember Client - Use Ember Client for any unlawful purpose or in violation of any applicable laws or regulations - Access, use, or attempt to access or use the software product in a manner that violates the security or integrity of the system or the data it contains - Distribute, sell, rent, lease, sublicense, or otherwise transfer Ember Client to any third party We may terminate your access to Ember Client at any time without notice or liability if you breach any provision of these Terms. Upon termination, you must cease all use of Ember Client and destroy all copies of Ember Client in your possession or control.
Account
To use Ember Client, you may need to create an account. You are responsible for maintaining the security and confidentiality of your account. You agree not to share your account information with others or allow unauthorized access to your account. Clyent Softwares Ltd is not liable for any unauthorized access or use of your account. By linking your Minecraft account to Ember Client, you grant permission for Ember Client to access certain information from your Minecraft account, such as your in-game username and UUID. This information is used solely for the purpose of providing you with the services offered by Ember Client and is subject to our Privacy Policy. You are solely responsible for any activity that occurs under your account. If you suspect unauthorized access to your account, it is your responsibility to notify Clyent Softwares Ltd immediately and take appropriate actions to secure your account.
Liability
Ember Client is provided on an "as is" and "as available" basis. Clyent makes no representations or warranties of any kind, express or implied, regarding the Service. You agree that your use of Ember Client is at your sole risk. Clyent shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from your use of Ember Client.
Service Availability
Clyent strives to provide a reliable and uninterrupted Service. However, we do not guarantee that Ember Client will be available at all times or free from errors or interruptions. We may need to perform maintenance or updates on the Service, which may result in temporary unavailability. Clyent shall not be liable for any loss or damage arising from the unavailability of Ember Client.
Warranties
Clyent expressly disclaims all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Clyent makes no warranty that Ember Client will meet your requirements or be available on an uninterrupted, secure, or error-free basis.
Indemnification
You agree to indemnify and hold harmless Clyent and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses arising out of or related to your use of Ember Client or violation of these Terms.
Intellectual Property
All intellectual property rights in Ember Client and its contents (excluding user-generated content) are owned by Clyent or its licensors. You acknowledge that you do not acquire any ownership rights in Ember Client by using the Service. If you purchase any virtual items within Ember Client, you acknowledge that such items are licensed to you and not sold. You do not have any ownership rights over the virtual items and they may be subject to additional terms and conditions. You agree not to reproduce, distribute, modify, create derivative works of, republish, download, store or transmit any of the material on Ember Client without our prior written consent.
